Terms of Use & Liability

Last updated: September 2026 · Applies to The Gun Exchange USA ("TGX"), serving Lancaster and surrounding Southern California / Los Angeles County.

This is a general summary, not legal advice.

TGX is a listing platform, not a law firm. The information below explains how the service works and the limits of our responsibility. Firearm laws in California are complex and carry serious penalties. For legal questions about your specific situation, consult a qualified California firearms attorney.

1. What TGX Is — and Isn't

TGX is an online listing service that connects firearm sellers with buyers in the Lancaster, CA area. We are not a party to any firearm sale, we do not sell, broker, store, ship, or take possession of any firearm, and we do not take a percentage of any sale. The sale price is paid directly between the buyer and seller in person at a licensed Federal Firearms Licensee (FFL) transfer site. Our only revenue is the one-time listing fee and the monthly membership subscription.

2. California Firearm Transfer Requirements

Under California law, the following apply to every transaction arranged through this site:

  • All firearm sales and transfers — including private-party sales — must be processed through a California-licensed FFL dealer under the Dealer's Record of Sale (DROS) process.
  • A background check is required for every transfer.
  • There is a mandatory 10-day waiting period before the firearm may be released.
  • The purchaser must present a valid Firearm Safety Certificate (FSC) or qualify for an exemption.
  • Buyers must be at least 21 years old to purchase a handgun (and generally 18+ for long guns, with limited exceptions).
  • The firearm must be picked up within 30 days of the DROS submission, or the process restarts.

TGX does not perform these steps — the licensed FFL transfer site does. Users are solely responsible for ensuring each transfer complies with all applicable California and federal laws.

3. No Warranties; Firearms Sold 'As Is'

We do not inspect, appraise, verify the condition of, or warrant any firearm listed on this site. Listings are provided by sellers, and we make no representation as to their accuracy, legality, or safety. All firearms are exchanged strictly "as is" and "with all faults." Buyers should inspect any firearm in person at the FFL transfer site before completing a purchase.

4. Assumption of Risk & Release of Liability

By using TGX, you acknowledge that firearms are inherently dangerous and that buying, selling, transferring, possessing, and using firearms involves serious risk of injury, death, and legal consequence. You assume all risks associated with any transaction or interaction initiated through this site.

To the fullest extent permitted by law, you agree to release, indemnify, defend, and hold harmless TGX, its owners, operators, employees, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses — including attorneys' fees — arising out of or relating to your use of this site, any listing, any transaction, any firearm, or the conduct of any other user.

5. User Responsibilities & Eligibility

By using this site you represent and warrant that you:

  • Are legally eligible under California and federal law to purchase, possess, sell, or transfer firearms;
  • Are not a prohibited person under 18 U.S.C. § 922(g) or California law;
  • Will complete every transfer through a licensed FFL dealer with a background check; and
  • Will provide truthful, accurate information and documentation when requested.

We reserve the right to remove any listing, suspend any membership, and refuse service to anyone at any time, including where verification documents are not approved or where a complaint is substantiated.

6. Governing Law & Jurisdiction

These terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from your use of this site shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the exclusive jurisdiction and venue of those courts.

7. No Attorney-Client Relationship; Not Legal Advice

Nothing on this site constitutes legal advice or creates an attorney-client relationship. Firearms-related legal questions should be directed to a qualified California attorney.

8. Fees, Refunds & Disputes

TGX charges only two fees, both paid through our payment processor: a one-time listing fee (an advertising fee for posting a classified ad) and a monthly membership subscription.

  • Listing fees are one-time advertising fees. Because the ad goes live immediately upon payment and the service is delivered in full, listing fees are non-refundable once the listing is published.
  • Memberships are billed monthly and can be canceled at any time from the Membership page. Cancellation stops all future billing immediately; you keep access until the end of the current paid period.
  • Refund requests: if you believe you were charged in error, or a listing was never published due to a technical issue on our end, contact us within 7 days of the charge and we will review it.
  • Disputed charges: before filing a chargeback with your bank, please reach out first — most issues can be resolved faster directly. You can reach us any time through the Contact form or by email at support@thegunexchangeusa.com.
